By accepting and undertaking a quest, you (the “Adventurer”) acknowledge and agree to the following terms and conditions. This Disclaimer of Liability is intended to inform you of the inherent risks associated with the Quest and to release the Quest Giver, their agents, and affiliates (collectively referred to as the “Releasor”) from any liability.
1. Acknowledgment of Risks:
The Adventurer acknowledges that the quest involves activities that are inherently dangerous and may result in serious injury, permanent disability, death, or property damage. Such risks may include but are not limited to, encounters with hostile creatures, hazardous environments, natural disasters, magical mishaps, and combat with enemies. The Adventurer accepts full responsibility for the risks involved, whether foreseen or unforeseen.
2. Voluntary Participation:
The Adventurer affirms that their participation in the quest is voluntary and that they are under no obligation to accept or fulfill the quest. The Adventurer acknowledges that they have the right to refuse participation at any time before or during the quest.
3. Assumption of Risk:
By choosing to participate in the quest, the Adventurer expressly assumes all risks and accepts full responsibility for any injuries, damages, or losses that may occur. The Adventurer understands that they are solely responsible for their safety and the safety of their companions.
4. Release and Waiver of Liability:
To the fullest extent permitted by law, the Adventurer hereby releases, waives, discharges, and covenants not to sue the Releasor for any claims, demands, damages, or causes of action of any kind arising out of or related to the quest. This release applies to all claims, whether arising from the negligence of the Releasor or otherwise.
5. Indemnification:
The Adventurer agrees to indemnify, defend, and hold harmless the Releasor from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of their participation in the quest and to reimburse the Releasor for any such expenses incurred.
6. Medical and Emergency Treatment:
The Adventurer acknowledges that the Releasor is not responsible for providing medical or emergency treatment in the event of an injury or illness occurring during the quest. The Adventurer agrees to seek medical treatment at their own expense and assumes all risk of medical conditions resulting from their participation.
7. Governing Law:
This Disclaimer of Liability shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or related to this Disclaimer shall be resolved in the courts of the United States.
8. Severability:
If any provision of this Disclaimer is found to be unenforceable or invalid, that provision shall be severed from this Disclaimer, and the remaining provisions shall remain in full force and effect.
9. Entire Agreement:
This Disclaimer constitutes the entire agreement between the Releasor and the Adventurer regarding the quest and supersedes all prior understandings, agreements, representations, and warranties, both written and oral.
By accepting/fulfilling the quest, the Adventurer acknowledges that they have read, understood, and agreed to the terms of this Disclaimer of Liability.
This Disclaimer of Liability is designed to protect both parties involved in the quest. The Adventurer should carefully consider the risks before agreeing to participate.
